This general information relates to Aussie Farmstay and Bush Adventures Pty. Ltd (‘The Company') tours.
1 General Conditions:
The company operates adventure tours and provide interactive experiences. Passengers are advised that they will be involved in the conduct of the tour and will assist the guide and fellow passengers with day to day activities (for example packing of trailer and preparation of breakfast and lunches).
One night of the Venture West Tour will involve camping. Passengers will need to bring a sleeping bag... If you are unable to provide your own sleeping bag it is possible to hire one at the time of your booking from the company.
Government regulations forbid smoking in tourist coaches and due to timetable constraints it may not always be possible to make stops to allow smoking.
Luggage is limited to one piece of not more than 20 kg for storage in trailer and one piece of standard hand luggage for carriage on bus.
Stated duration counts day of departure and day of return. Twin share prices are per person unless otherwise stated. The Company reserves the right to cancel any ticket or booking or refuse to carry any passenger at any time.
Prices include Australian Government Goods and Services Tax.
The company reserves the right to refuse to deal with, or continue to deal with any passenger or transport their luggage or goods, if that passenger causes distress to other passengers or the tour guide.
Solo passengers should email the operator before booking to check which departures are available as all tours need a minimum of 2 passengers to proceed. A processing fee of $57 will apply to solo bookings which cannot proceed.
In the event of a passenger cancelling a tour the following amounts will be refunded:
Up to 14 days before tour departure date: 100% of payment will be refunded - $57 processing fee.
Between 14 and 7 days before tour departure: 75% of payment will be refunded - $57 processing fee.
Between 7 days and 48 hours before tour departure: 25% of payment will be refunded.
No refunds will be paid for cancellations made after 48 hours prior to tour departure.
If a client fails to take up or complete a booking no refund will be made.
In the event the Company is forced to cancel a tour or booking:
In the event the Company is forced to cancel a booking prior to commencement of the tour all customer payments will be fully refunded.
As is normally the case with group tours, a minimum number of bookings is required in order for a tour to be financially viable. In the event that adequate numbers cannot be achieved, it will be necessary to cancel a scheduled departure and to offer the nearest possible alternative date (or a full refund of monies paid minus the booking fee of $57). The date on which the decision is made whether a tour will operate is usually 14 days before the scheduled departure date.
Once a tour has commenced there is no refund of fare or unused portion.
The Company will take all reasonable steps to provide an enjoyable tour, but accepts no liability for any loss of enjoyment experienced by passengers.
The Company further accepts no liability for any loss beyond its reasonable control and provides no warranties in addition to those set out under the Trade Practices Act 1974, and nothing herein restricts any passenger from exercising their rights and remedies pursuant to law.
These tours include the services of operators other than The Company, which are not under the direct control of The Company, and whilst The Company takes all reasonable care in selecting these operators, it cannot accept responsibility for those operators' conduct or the conduct of their representative employees or agents or for any ramifications of that conduct.
These tours include activities such as Visits to a working sheep station, Bushwalking and Horse riding, passengers accept that degrees of risk are involved.
No passenger will be permitted to embark or continue on tour while under the influence of drugs; or their mental or physical condition is, in the opinion of any representative of The Company, such as to render them incapable of caring for themselves; or whereby they act in an unsociable manner as to become objectionable to other passengers; or they become a hazard to themselves or other passengers; or engage in Criminal acts. The Company will not be responsible for expenses resulting in such persons being precluded from completing the tour.
Itineraries described on the Company’s web site and promotional material are subject to alteration without notice and intended as a guide only. Alterations may come about due to adverse road or weather conditions, local flooding, strikes, public holidays, local festivals, or other reasons beyond the control of the Company. Examples of conditions that may impact the planned itinerary include total fire bans which prevent the use of open fires or the outbreak of Equine Influenza that may prevent horse based activities. The Company can give no guarantee as to the exact arrival and departure times of the tour and The Company will not be liable for failure to make connections with any other services or attractions. Any additional expense incurred by the passenger is not The Company's responsibility.
Passengers acknowledge that the company will provide its services only on the basis of each passenger's prior acceptance of this disclaimer as signified by their participation in the tour. This information, while correct at the time of publication, may be subject to change.
On the morning of departure of your Aussie Farmstay and Bush Adventure Tour all passengers will be required to sign a waiver confirming acceptance of the following terms as a condition of travel.
The Company shall rely upon true and correct information that the passenger provides prior to participating in recreational activities of and incidental to things that may include but are not limited to the following:
In undertaking the Tour, each passenger accepts the Company’s rules and regulations;
Passengers accept that the activities undertaken on the tour are not without inherent risk and in entering into this agreement they acknowledge that they are not relying on any oral or written statements made by the Company or its agents, whether in brochures, advertisements, websites, and correspondence or in conversations that lead it to engage in this tour.
Passengers shall release the Company and all persons or corporations associated directly or indirectly with the conduct of the activities from all claims, demands and proceedings arising out of each passengers participation and hereby indemnify them against all liability (including liability for their negligence and the negligence of others) for all injury, loss or damage arising out of or connected with their participation in the tour. This release shall extend to and include The Company’s owner, partners, managers, officers, agents, and contractors, appointed for the activities; the owners, licensees, and occupiers of land on which the tour or any part of it are conducted or which is involved directly or indirectly with the tour in any manner whatsoever and promoters, sponsors and activities organisers. This release and indemnity continues forever and binds the passenger’s heirs, executors, personal representatives and assigns.
The Company relies that each passenger has
Passengers acknowledge that they have the sole responsibility for their personal property during the tour. Passengers acknowledge the terms and conditions of this document are contractual in nature, are intended to have legal effect and are not a mere warning or recital.
The Company is not responsible for the Passenger’s decision to nor has it induced the Passenger to participate in the activities on the tour.
5. Travel Insurance
We strongly recommend passengers to take out travel insurance to cover any unforeseen circumstances which may arise (including cancellation fees, medical and curtailment expenses, loss of luggage, early departure from tour due to death or illness etc.). Ask your Travel Agent for details at the time of booking
